Under Missouri Revised Statutes §537.090, “Damages to be determined by jury—factors to be considered,” the compensation that can be recovered in a wrongful death claim can include any damages that may be deemed fair and just for the death and loss as a result of an act of negligence or recklessness. The statute lists a number of factors to be considered, including financial losses for funeral expenses and the loss of the reasonable value of services, consortium, companionship, comfort, instruction, guidance, counsel, training, and support of the people who are filing the claims.
In addition, the claim can include damages that the deceased suffered between the time of injury and the time of death, provided that he or she would have had a right to recover those damages had the death not occurred. It is important to note, however, that a wrongful death claim in Missouri cannot include damages for grief and bereavement, unlike such claims in many other states.
